Buffalo Gym Owner’s Lawsuit Against Cuomo Postponed To Dec 23; Seeks To Allow All Businesses To Re-Open

Robby Dinero, the owner of Athlete’s Unleashed has had his court case postponed until December 23. The case was originally scheduled for December 16. The state then requested an extension until December 18 to have more time to prepare for the case.

This time, Dinero is told the postponement is due to the Zoom call schedule.

Dinero, who is represented by prominent attorney Paul Cambria, made headlines when business owners stood up to the Health Department, who tried shutting down a protest gathering on his property.

The lawsuit challenges the lockdown as a whole and the constitutionality of the orders and powers of Governor Cuomo. A win for Dinero would be a win for all small businesses who are restricted under Cuomo’s lockdown orders.

This is the first lawsuit of its kind in New York State.

Lawsuits have been going in the favor of the plaintiffs lately, as churches secured a recent victory and just yesterday, Zoom Tan won their case against the state as well.
