A Supreme Court judge has just sided with businesses again.
Judge Henry Nowak sided with plaintiff, Hutch & Associates who sued claiming that the designation in Erie County was “arbitrary and capricious” as well as abuse of discretion.
The suit filed stated that the Orange Zone restrictions violated executive law 29-a(2).
This order comes just days after restaurants won a temporary restraining order to open under yellow zone.
