All Erie County Restaurants Can Now Open For Indoor Dining After Lawsuit

Erie County Executive Mark Poloncarz released a statement saying that all permitted food establishments can now open in Erie County.

That comes after a court win for the restaurants in New York Supreme Court where Judge Nowak granted a restraining order allowing indoor dining.

The establishments will still have to operate as yellow zone, which requires 10pm curfew and 4 to a table max.

The bad news however, the enforcement doesn’t apply to the State Liquor Authority. Any establishments serving alcohol outside the 91 in the lawsuit, would still need them to sign off in order to serve alcohol indoors. (UPDATED BELOW).

Poloncarz relaxing of enforcement only applies to the ECDOH.
